Modica v Dr. Wilcox
Cause No. D182-951, District Court of Jefferson County, Texas
The plaintiff claimed against her doctor "compensatory damages for medical expenses and life care expenses for past and future losses" in addition to "non-economic damages", "HANDICAPPED ACCESS" (the plaintiff's emphasis), and "punitive damages for wantonly acts and reckless conduct".
The plaintiff represented herself ("pro se legal representative") and the rather unusual "petition", emphasized with capitalized and underlined allegations, in addition to 'cut and paste' verbal images that look like a ransom note, accused the defendant of, among other things:
"gross treble negligence"
"the biggest Wantonly act of tom-foolery monkey-business ever imaginable"
According to the plaintiff, "Dr Wilcox gave me a heart attack",
"The only way that I am to get the help that I need is to tell my doctor of my symptoms. I'm in the middle of trying to tell him the entire situations, and being cut off in mid sentence is wrong. I lose my train of thought and I don't get to finish what all I wanted to say. I was made to have a heart attack right there in his office. And, that is true."
The plaintiff complained that the doctor had "an exaggerated sense of self-importance and a feeling of superiority to other people" and that, not unreasonably,
"I can assure you that when patients are experiencing pain and need the help of their physician, they only desire care, compassion, kindness, a listening ear...AND TREATMENT...NOT AN ARGUMENT. This man forces me to have to emphasize things in order to get him to hear me. It is ridiculous."
The plaintiff also has some "sincerest recommendation" for the defendant
"It is my sincerest recommendation that a psychoanalysis should be in order for Dr. Wilcox. I am not trying to be mean to him. I am just serious in that there is a "PATTERN" of behaviour that is "CONDUCT UNBECOMING and MALPRACTICE."
According to Southeast Texas Record, the plaintiff was sued an attorney (for "verbally assaulting her with sarcasm") and ex-President Bush.
